DEAL or no DEAL? No DEAL

The courts have started to take the initiative in striking out Deal Claims, as this Court Order from pepipoo shows.

DEAL have until 4th March to find a Practising Certificate for Mr Shwarts, which is going to be difficult as he doesn't exist, so the claim is effectively struck out.

The copy of the 'assignment of the alleged debt' will be interesting to see too. District Judge Potts seems well informed on the easiest way to clear out claims which should never have been brought in the first stage.

Hopefully the next step will be to bar DEAL and CEL from bringing claims in the first place.

  1. In my perfect world, the order would stand even if they drop the case.

It's probably too much to hope for.

  2. They won't be able to produce anything if they're banged up in a Scottish Prison.

    Just a thought.

    1. As the directors of CEL are apparently straw men (QA Nominees Limited and Mr Willem Marthinus De Beer), it may be some time before the actual controlling interest is identified and toothbrushes packed.

  3. I am bemused that where there is a long term deliberate use of misleading information before the court, I do not understand why the courts themselves to not bring a contempt of court action, or get the police/CPS to bring a perverting the course of justice action. It brings the legal system into disrepute that untrue information has been tolerated for so long.

    1. It's because there is nothing that joins everything together, and the companies know this and know they can get away with it.

For instance for a long time ParkingEye told the court their average cost per ticket was £53, when their accounts showed it could not be more than £18. Of course, this week it was revealed even that was bogus and their counsel stated he could not identify any loss apart from the potential to get sacked by the landowner
